Halsbury's Laws of England 1st edition London 1907 Volume 6 pp 257-262 Ditto vol 16 pp 306-309 Burge's Commentaries on Colonial and Foreign Laws Generally and in their conflict with each other and with the Law of England Various 19th century editions Vol 3 Marriage Abstract of the Legal Preliminaries to Marriage in the United Kingdom, in India and the British Dominions beyond the Seas H.M.S.O. London 1st edition 1908 and second edition (slightly different title)1951. I only have the second edition. There is a review of the second edition by Otto Kahn-Freund in the Modern Law Review 1952 which I have not read. Stephen Cretney Family Law in the Twentieth Century OUP Oxford 2003 Chapters 1 and 2 and the extensive bibliography Lord Davey Status in Connection with Colonial Marriages (1900) 2 Journal of the Society of Comparative Legislation NS 201 Hansard remains the best source for why any legislation is introduced The Times available through Times Digital Archive tends to record any educated public debate. I am not sure the 1848 report is particularly significant but the Chelmsford report of 1868 definitely is. It primarily deals with the related problems of the disparity of marriage laws between England, Scotland and Ireland which became more acute as more people moved about. Gary
