H-ASIA April 13, 2007 Further on an earlier controversy on menstrual questionnaires in India ************************************************************************ From: Genevieve Lakier <glakier@hotmail.com> With reference to Joanna Kirkpatrick's post, since we're on this topic, it might be helpful to point out that this isn't in fact the first time this issue has come up in recent decades. In 1992, in fact the Indian Supreme Court ruled that the right to personal liberty meant that women could not be asked for information about menstruation or pregnancies on applications for jobs in the public sector. The case was called Neera Mathur v LIC (1992). I know this simply because of SP Sathe's book on Judicial Activism in India which mentions the case but does not discuss it at length. If anyone knows what that original case was about, or why its come back, I would be very curious to learn more... Genevieve Lakier Harvard University Ed. note: I knew Professor Sathe and knew of his interest in this sort of public interest case. Alas, he passed away in Pune over a year ago. I recall friends in Mumbai expressing concern about the Life Insurance Corporation of India's attempts to document the menstrual information of women applicants for employment.
